By using RealEstateReportReady (“the Service”), you agree to these terms. If you do not agree, please do not use the Service.
1. Service Description
RealEstateReportReady provides workflow tools and educational materials for title and escrow teams evaluating reportability under the FinCEN Residential Real Estate rule (31 C.F.R. Part 1031). It does not provide legal advice and is not a FinCEN filing service.
Important Disclaimer
Determinations generated by this tool are rules-based analysis outputs, not legal opinions. Results should be verified by qualified professionals before reliance. The Service does not replace legal counsel, and no attorney-client or advisory relationship is created by use of this tool.
2. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Rely on determination results as a substitute for professional legal review on transactions with material compliance consequences
- Submit intentionally false or misleading data to the checker
- Attempt to overwhelm, overload, or interfere with the Service
- Scrape, copy, or redistribute our content or analysis without permission
- Use automated tools to access the Service at scale
- Misrepresent your identity or professional affiliation
3. Intellectual Property
The Service, including its design, code, content, templates, and educational materials, is owned by RealEstateReportReady. You may not copy, modify, or distribute any part of the Service without our written permission.
Purchased products (Filing Kit, Agency Pack) are licensed for use within your organization. Determination PDFs generated by the checker are yours to share, retain, and include in your transaction files.
4. Data Accuracy
We strive to provide accurate analysis based on the FinCEN Residential Real Estate rule framework, but we cannot guarantee that results are error-free. Regulatory interpretation evolves, and transaction facts may be more complex than the inputs captured by this tool.
You should verify important findings independently and not rely solely on our analysis for critical compliance decisions.
5. User Responsibility
You remain responsible for validating legal obligations and filing requirements for each transaction. The Service provides workflow support and educational context, but filing decisions, deadline management, and beneficial ownership collection remain your responsibility.
6. Limitation of Liability
To the maximum extent permitted by law, RealEstateReportReady is provided “as is” without warranties of any kind, express or implied. We are not liable for any damages arising from your use of the Service, including but not limited to:
- Loss of revenue or business opportunities
- Compliance decisions made based on determination results
- Missed filing deadlines
- Service interruptions or downtime
- Data loss or security breaches
Our total liability is limited to the amount paid for the applicable product purchase. For the free checker, our liability is limited to zero.
7. Indemnification
You agree to indemnify and hold harmless RealEstateReportReady from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or failure to verify legal obligations independently.
8. Service Changes
We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these terms. Continued use of the Service after changes constitutes acceptance of the revised terms.
9. Termination
We may terminate or suspend your access to the Service immediately, without notice, for any reason, including breach of these terms.
10. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States.
